Is there somewhere I can find out where I am at in the foreclosure process without calling the lender or giving out my credit card info online?
We received notice of default that was filed by the lenders lawyer on 8-25. On 8-29 we sent a letter asking for the 3 month extension to try to work out things with the lender. On 9-13 we received a work out plan to fill out from our lender but after talking to a lawyer we decided to not send it back and let it foreclose. From what I understand the 3 month extension should have ended and the home should have been published and it is now past the 15 days the lender has to post a copy on the home.
The lender called today and left a message to see if we still wanted help, which is total BS because they have fought us on past pleas for help until we forced them to send us the work out by consulting a lawyer. So I am wondering if they have published it yet. The only thing I can find online is stating that our preforclosure is inactive.
I keep having nightmares of coming home one day and the locks are changed with my pets and belongings inside. I was told there is a 6 month redemption period but the lender has been very dirty up to this point and I want to make sure I am protected to have time to move.
Also the law in Michigan says:
If the amount claimed to be due on the mortgage at the date of the notice of foreclosure is more than 66-2/3% of the original indebtedness secured by the mortgage, the redemption period is 6 months.
We are $64,000 under on the 1st mortgage and $24,000 on the second for our single family home. We are still considered part of the 6 month redemption law correct?
