I have lost my house to Bank of America via a trustee foreclosure sale. The BofA first mortgage was paid in full by the sale price, which was paid by the BofA heloc, which is a recourse loan. Does the heloc, which now owns the house, have the legal ability to pursue me and secure a deficiency judgement, even though it was sold-out by the BofA first mortgage?? Does Simon v. Superior Court (BofA) relieve me from the deficiency judgement liability to the heloc?
