    BofA & Court Records

    We filed Chapter 7 Oct 2009 and were Discharged Feb 2010. We quit paying the Mortgage May 2009 and havent heard much of anything from BofA. I've been looking at the Court "Case Look Up" info periodically and yesterday it shows the following:
    Affidavit of Inddebtedness
    Certificate of Possession of Original Note
    Certificate of Non-Military
    Application for Default Judgment
    Certificate as to the State of Record

    I guess they're finally working on moving towards completing the Foreclosure. Any idea of what we should expect next? I'm sure we'll be served but does this mean we'll have 30 days? We are a judicial foreclosure state.

    I was dreading the day this would come.

    It looks like the lender is asking the courts to remove the foreclosure "stay". It's routine in a BK. Once it is lifted (and it look like it has been due to the possession of original note paperwork), the foreclosure can proceed with the courts permission. As far as 30 days ? Depends on how fast the lender moves. Mine took about 80 days from lift of stay to receiving Notice of Trust sale. But, I'm in California a non judicial state.
