    Tax question?

    I was just checking my county website to see how much past due I am on the property taxes bc I planned on paying them in October. I was surprised to see that there was a payment made 2 weeks ago and the account was brought current. So I called them and she told me WF paid the property taxes. My taxes and ins was NOT escrowed in my mortgage.

    Any idea why they would pay? Are they gearing up to start FC soon? I have not had any contact with them since the loan mod denial letters came in. I asked my attorney the other day if they filed for relief of stay and they have not.

    HSBC paid mine when the 1st half year was like about 3 months past due...then they put it on the account in 12 equal installments to pay back...so I think this is normal and they'd do it regardless....

      Do you have permission to discuss your mortg. with WF? If so, I'd call them and ask whats up. Usually if you dont have escrow built into your mtg payment, they dont automatically add it w/out notifying you.

      ETA: hmm..guess they can add it w/out notifying you...wording in your deed of trust / mortgage usually has a provision.

        They did not file for relief of stay so they won't speak to me. They never paid it in the past when it was late.

          My taxes and insurance are escrowed, but I have not paid mortgage since 02/11. BOA paid the 1st tax installment 2/25/11 while I still had money in escrow, then paid second installment 08/25/11, which put me at about -$1400.00 in the escrow account. I know the mortgage company's normally do not want to lose these homes to a tax lien, so they pay the taxes on them. And because I have PMI (private mortgage insurance due to less than 20% down payment) they ever so nicely pull that out every month and pay it as well. They do conveniently send me a mortgage statement every month to our new address in our new state, letting us know they know we BK'd and the home was included, and they are just letting us know for informational puposes.

          I wish they would just foreclose on the stupid place as we have moved on, but we are in it for the long haul on waiting this out, sigh...

            I'm actually happy they did pay b/c I was getting ready to pay the delinquent taxes this month. They just saved me 2k. I'm just concerned that they are starting the FC process sooner than later....

              I know JB had a post re: past due real estate taxes on here - something about statutory liens vs. other types of liens in a Ch. 7 that may not be discharged in a Ch. 7. You may want to read it.

                Oh so maybe I will have to pay this after the FC process is done?

                    I'm in FL so they are statutory liens. I never listed the taxes on my BK? No one asked me about it. B/c my taxes were not escrowed I always paid them with my income tax return. I usually pay them in March for the previous year. WF paid my 09 taxes and I still owe for 2010 which wouldn't go to a tax sale until March 2013.

                    I hope I didn't screw something up....
