    At what point should we apply for mod?

    Hello all,

    My ch 7 was discharged Feb 2011, (husband did not declare bk). We kept up w/mortgage pmts long as we could. Missed first payment May 2011. I have not heard anything yet from BoA - I'm thinking because they cannot attempt to collect since I was discharged (??) I know it's still pretty early. And from what I understand, they still can try to contact my husband. My question is at what point should I apply for a modification? I don't want to reach out to them first and draw any attention to our situation, but I don't want any surprises either. Any advice? We live in NJ. Thanks.

    Are you seriously WANTING a mod, or is this part of your plan to delay things?

    If it is a delay tactic, I would wait to hear from them. It may be a while, but you likely WILL hear from them.

    If you are seriously wanting a mod, then no one can really guide you. If you want a mod AFTER delaying the longest time possible, I would imagine you could throw dice in Vegas and have better odds of timing a win. It is just impossible, these days, to know what a bank might do and what timeframe they might follow.

      Thanks for your reply. Yes, we do want the mod - we don't want to leave our house. Guess we'll have to just see how this plays out.
