    Confused re: Ch 7 discharge and HAFA

    Hi all

    I am hoping you can help me clear up some confusion.

    To make a long story short, I have been the nitemare loan modification process with Chase for almost two years now. Was appoved twice for trial modification, made required payments, plus extra. Both times denied because they lost my paperwork.

    Due to some unseen financial hardships of trying to pay the outrageous mortgage, in a last ditch attempt to save my place, I filed Chapter 7. My mortgage was discharged through bankruptcy.

    I was denied once again for a loan modification for some rediculous reason. Then today I received paperwork to fill out for the HAFA program.

    My question is, if my mortgage was discharged in my bankruptcy, do I simply walk away or do I need to fill out the HAFA paperwork? I would love to fight and stay in my place but I am underwater and I am not sure how much longer I can deal with Chase. Should I try again one last time for a loan modification?

    If I do not fill out the HAFA paperwork, what happens next? Should I just stay in my place until I hear something further?

    I am at my wits end and don't know what to do next.

    I'm am in the same boat, mortgage was discharged DEC. 2010 in bankruptcy (1st and Heloc) I did not fill out the HAFA paperwork which was sent to me after the discharge. Last docket movement was 2/23 2011 non-participation in HAFA. No movement since (I keep checking docket) Next thing I should see is MSJ hearing. Made last payment May 2010. Do not want to save the home too far underwater, bank can have it. Question is when will they move to take it?

      From what I just learned, the bank has nothing to do with your loan once you decide to go with HAFA, which is a government program. You could wait forEVER for anything to happen. That is why I decided to go with a regular DIL.
      Tried debt settlmnt, stopped paying all cards 5/09/--filed bk no asset ch7 in 11/2010---DISCHARGED 2/2011!!! Still waiting to see how much more Bank of America and Fannie Mae can ruin us

        I did nothing with anyone. no answers no replies, no nothing to anything that was sent just ignored all.... (summons, calls, letters on advice from lawyer) Bank was granted a relief from stay before the discharge and here I sit waiting.... still in house and will be until forecloses.. Will update.
