    Was this my NOD?

    Hi everyone. I've read a lot of information on this forum but I'm still confused about what I received last week. I am in VA and was discharged in December. Did not reaffirm mortgage and stopped paying Jan. 1. I received a certified letter stating that I was late and had 30 days to contact Suntrust before they accelerated the loan.

    Do they really send the NOD that early? I'm trying to figure out how much time I have now before they start foreclosure and also whether I should call to try and put them off a little longer. Any suggestions would be really helpful. Thank you!

    While I'm not in Virginia and cannot say with certainty, but it does not sound like NOD. Especially because you are only a month in default, right? It sounds only like an attention-getting, serious late notice. You might as well call Suntrust and ask then to clarify the letter. I see no harm in that.

      Thanks. I didn't think it was the NOD, but since it was send by certified mail, I didn't know what else it would be. I'll give them a call next week and see what they say. I want to get the most time out of this that I can. Any other thoughts are appreciated.

        My notice clearly stated in large bold letters, NOTICE OF DEFAULT at the 3 month mark. Then it took them another 7 months (just this month) to send the attorneys letter stating that a sheriff's sale would be forthcoming. Here in MN you then have a 6 month redemption period. Your lawyer should have told you the procedure.

          @discouraged- the 6month redemption period is after the foreclosure and does not affect the foreclosure process.

            BKParalegal - Help me understand that please. The paper I have from Minnesota Home Ownership Center says, at 7th missed payment Sheriff's sale occurs. (Deadline to bring mortgage current). Under that is '6 month redemption period immediately follows Sheriff's sale. Homeowner retains right to occupy house and payoff entire Sheriff Sale amount, including fees. Must pay amount or vacate house by end of redemption period or face eviction.'

            Is that what you were also saying? My finance couselor told me that once the Sheriff's sale happens it's basically a done deal. Took me a while to accept that as I, at first, wanted to keep my house. But, after being unemployed for so long and being of an older generation, I recognize that is not going to happen and am preparing myself for an eventual move.

              My lawyer didn't mention any foreclosure info so I've just been finding out the timeline on my own. It seems that VA moves much faster than other states.
