    FINALLY! It took 23 months!!!

    We just got notice that our home will be up for public Auction in June. Exactly 23 months after we missed our first payment. We had a short sale go through, only to have the plug pulled by our BK attorney. We had to move because of job loss and I am SOOO glad that we can finally see the light at the end of the tunnel. foreclosure this june, bk (hopefully) successfully discharged next june (2012). YIPEE!!!
    Our mortgage was through Chase and backed by Fannie Mae.

    Just FYI- we started out applying for load mod-made 4 months of "reduced" payments, only to find out that even though they took our money, it was not applied to the original loan, only back interest. We were given an option of a "balloon payment" for 80K more that we could sell our home for.
    After that, we didn't know what else to do, so we filed bk (mostly hospital bills and credit card debt from that)..and was told to "let it go" by our attorney. Saved up to pay back medical bills not included in bk (dr. we were still seeing) and for moving and getting into a rental. Then husband was laid off. Well, then we tried for a short sale. We really felt morally obligated to do something. We tried. We really did. At the end of the day, we did everything we could. It's a business transaction. I am so glad I did and I wish we would done it sooner.

    Hopefully this will help someone who was in our situation to know they are not alone...

    We stopped making our mortgage payment last April (2010) and still haven't heard anything. Like you, thinking about the last 4 or so years, we really did try everything (working mutiple jobs, selling items, counting every penny, etc.) and in the end, we just couldn't afford our home any longer. So now I just have to look at it as a business decision and what's best for our future. My ch13 should be completed May 2012 and I'm wondering if it will get done before the foreclosure is finished. Like you, my husband lost his job early on in our ch13 and that is the straw that made us decide to forgoe the house for our future. It's good to see someone with a positive outlook on this whole process. It'll be nice in 2012 to not owe anyone anything (well except for a small student loan I have that I have been paying on since the ch13 started). Best of luck to you!

        WOW!!! Flower04, I had no idea that a foreclosure process could take as long as 23 months. Right now, I am 6 months behind in my mortgage. Normally I get at least one call from Bank Of America Monday through Friday (sometimes on Saturday and Sunday), requesting me to call them about my mortgage. Believe it or not, I have been getting calls from them every since I was 17 days past due. Yet when I was 2 months behind, I received a FedEx letter from B of A, telling me that my mortgage was two months behind and that they were giving me one month to try to catch up otherwise they would start foreclosure proceedings. I also got the exact same letter 5 other times over the next 5 business days (4 times by FedEx, and one time by certified letter from the regular SnailMail). Then in late October, B of A got into trouble because of the robo-signing scandal, so I was hoping that would buy me some time. Yet since the robo-scandal, I have not received any other foreclosure paperwork from B of A, yet I am still receiving my monthly mortgage bill.

        Billssuck, I am surprised that you have not received any late notices or pre-foreclosure paperwork from your lender, since your last payment was April 2010. I wonder what is going on that they have not contacted you thus far? Are you still currently in your home?

          Is the 23 months from todays date? Or will that be in June? If its from todays date, that would mean 29 months IF the sale doesnt get cancelled. 6 months notice for a sale is a long time. I wonder if I will have that long.

              23 months since we made our last mortgage payment until auction date. we werent' expecting 6 months notice about the auction, but we aren't stopping it. I want this to be over and done with already. We moved over a year ago out of the area

                This gave me a good laugh. And it really does "recap" quite poignantly.
                Tried debt settlmnt, stopped paying all cards 5/09/--filed bk no asset ch7 in 11/2010---DISCHARGED 2/2011!!! Still waiting to see how much more Bank of America and Fannie Mae can ruin us
