    Okay, Jman, I've got an appt. with them. But, in the meantime, where is the best place to look up Ohio laws on "eviction" or "notice to vacate enforcement"? I'm desperately seeking a way to at least get more than 2 weeks so that I can find another place and get my security deposit if need be. And, anyone else on the thread who can give advice, please do.

      When is your appointment with Mr. Jarnicki? He should be able to fill in all the details for you.

        From the Ohio Bar Law Website:

        Q.: Can I save my house even after the foreclosure sale?
        A.: Yes. You have a right to buy your house back after the sale and before it is confirmed if you can pay the amount you owe against it in full. This right is know as your "right to redeem the property." See an attorney for details about how to accomplish this.

          Thanks Jman. It's Thursday. Not sure I'm comfy with meeting for lunch under these circumstances....that would be the end of my annonymity! This is one situation I don't want to put a face with a screenname on!

            LOL I understand that! But you have nothing to be ashamed of. Everyone on this forum is in the same boat. The system is designed for most people to fail. Just stay calm and make sure the lawyer works for you.

              If you can file for BK before the eviction goes further, it will buy you some time and deal with the debt from the house if it ends up that they can't sell it for as much as you owed. The automatic stay will stall that process.

              Consult w/ an attorney ASAP! I'm not sure, but if you file 13, you might even be able to get the house back. I've heard of repo'ed cars being returned w/ a ch. 13 but I don't know the time frame between repo and filing.
              Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

                How long have you been at your current job? One of your posts says that you lost your job right after a garnishment fulfilled a judgment. If you have a good job with little debt, why haven't you been able to make the mortgage payments? Filing a Chapter 13 bankruptcy might buy you some time, but if you want to keep living there, you have to be able to get current on the mortgage and keep paying it. And once you file, you can't take it back, so it'll go on your credit report and affect your credit even if the bankruptcy is dismissed.

                I know you're scared. I totally understand. Making an appointment with a bankruptcy attorney is a good step, but I think you should also start coming up with a contingency plan should you have to move. Two weeks is not a lot of time. Call family, friends, your church, or social services for help. Find someplace you can go at least temporarily. The sheriff isn't going to avoid removing you just because you're not ready to leave.

                  If you sell/transfer your right of redemption to your ex-landlady before the sale is confirmed, she should be able to use that right of redemption to buy the house for what you owed plus interest and collection fees now. I would ask the lawyer you are going to see about that option since staying in the house seems to be what you would like.

                    That's pretty much what we got when we called to try and stop our Foreclosure. No sympathy. No nothing. We have a buyer who's pre approved, can go a swing loan, but the deal is contingent on him selling his house. No response.

                    Our Realtor called a buddy of hers on the inside of our Lender's company. He said wild horses can't stop it. We need to pay up or else.

                    Turns out our Lender is just a mortgage servicer. Somewhere is an Investor that holds the key to our mortgage. Our Lender has a contract with the investor, and the lender is just doing what's required in their contract.

                    When you call and chat with your Lender, ask who your investor is. You might also ask for contact info. The Lender will probably give up the investor but may not give you contact info. Maybe a little internet research will produce a viable contact for you. The investor can decide to halt the proceedings and direct the Lender to do as they command.
