    Timeline after BK

    If you filed Ch.7 where you in foreclosure before you filed? If you BK has been discharged are you still in the house and how long has it been?

    It seems hard to predict what the time table it. Spoke with an attorney who we have retained yet and he said it depends on the bank and they move faster after BK, but just want to see what others experience is on it to get a better idea.

    We where served papers in August 10, after not paying for almost 5 months. the process has been delayed since we had an attorney. We are hoping to file the end of Dec. Hoping to get after the BK we can get a couple months.

    I had Chase only a first mortgage. I was 4 months late when I filed last November, discharged in February of this year. NOD (foreclosure process for CA began) was filed by trustee in May 2010, 90 days later trustee took home back (moved out 3 weeks before, could have stayed till after the Sheriff's sale), but was not sold at Sheriff's sale until September 2010 (back to bank). You should get a couple of months... if the Bank doesn't file a relief of stay during your bk, the foreclosure is on hold until your discharged.
    November 2, 2009: Filed Chapter 7, December 10, 2009: 341 Done! January 11, 2010 Last Day for Objections! February 9, 2010 Discharged!!! February 12, 2010 Case Closed, MyFico on 11/09: 550, Now: 715!

      We missed 3 payments by the time we filed for BK...that was Sept 1st and we just got served about 3 weeks ago. Tomorrow is the last day for creditor objections..but other than that, we haven't heard anything. I'm not sure where exactly we stand, i check the county website for sheriff's sales...it goes to the end of January and we aren't listed in there yet. So as of now, we're on month 5, going on 6 - and still in our home. I wish i had a better idea of WHEN we were going to have to leave, but i'm thankful for every month of living rent free! Hopefully we can get thru the winter!

      P.S. 2 weeks after filing for BK, we got paperwork from our mortgage company's atty's asking for relief from the automatic stay..it was granted and they started the FC process...

        I received a NOD after missing about 5 months of payments, did 2 loan mods (missing the final payment of my second loan mod), then filed BK in Sept 2010.

        Estimating discharge at the end of December (90 days after 341 hearing) - but not sure

        I have zero clue how long I have left in my house. After discharge I am really hoping to find a job so I can then rent a house. My biggest fear is getting foreclosed out of this house before finding a job, then trying to convince a renter to rent to me.

        I do have a BK attorney, so hopefully he can buy me as much time as possible in the house until I find a job and can rent another place.
