    Served Again?

    I was served today with a Summons (says need to respond to the complaint attached within 30 days of service) The complaint - Complaint for Foreclosure.

    I was serve with this same exact document 1 year ago minus the page that says I need to appear in court on 1/15/10.

    We filed Ch-7 last October (10/09) and were discharged Feb (2/10) of this year and we're giving the house up.

    Does this mean they're starting the foreclosure over? I would have thought that they would have had their Default Judgment by now. We are living in the house and would like to stay as long as possible, but doesn't look like it'll be much longer.

    What's the next step after this?

    You could respond, but if not up to date in payments, why bother? So you got a bit of free rent. Not so bad. It may take six months of process before you need to move. Casually look around in that time. Find a nice affordable place. 'Hub

      Thank you. I am so green to this. I've read as much as possible but it all seems so foreign to me. I appreciate your response, it give me an idea of how much time we may possibly be looking at. I keep thinking we're going to have to get moving quickly.

      Forgot to mention this is a BofA Loan.

        It goes over the process for you - first court date, then short period of time to catch up on mortgage, then notice of sale, then sale.

        The notice of sale has to be at least 30 days. So you will know when it's time to move into the next (& better) part of your life.

          Wow you have lived in the house a long time rent free, I am hoping my timeline will be about that long.. My mortgage is with CiTi and my BK was discharged last week...
