    Mediation in New York.. is a lawyer necessary?

    I'm going into foreclosure mediation on the 18th of this month, after first getting BoA to agree to a modification and just after we've made our first trial payment. We were advised by BoA that after the first trial payment was made the foreclosure would be put on "pause". My question is, at this point, is it necessary for me to bring a lawyer with me to this mediation, considering that a modification agreement has already been reached between myself and BoA? I'd prefer not to have to pay a lawyer if it isn't necessary, since that money could be better spent towards making the trial mortgage payments. Thanks in advance for any advice!

    I have been involved in mortgage mediation in my state using lawyers and also representing myself. I did not find that the lawyers were any more knowledgeable about the process than I was. I learned a lot by reading posts on this forum and checking out some consumer websites. I found that I had to tell my lawyers how to approach my case, so I fired them. I was doing more work than they were. I can say that over 18 months into the mediation process, I am no further ahead by having lawyers represent me.

    If you hire an attorney to represent you at the mediation, I would recommend that you get one versed in consumer law, especially one that has experience with foreclosure mediation and can provide references.

    Also, the mediator is an impartial person who you can ask questions about procedure.
