    Is it normal to be served during Foreclosure Process after Chapter 7

    We have filed Chapter 7 in FL, been discharged, and did not reaffirm our home. We have since moved out. Our lawyer said we could just walk away.

    Last night, we came home and found a Certified Process Server notification for the 12th Judicial Circuit Court. Is this part of the process or what should we expect?

    In a judicial foreclosure state the bank still has to go to court to take back the house. It is just part of the process.
    3/2/09- Filed: chapter 7 / No asset
    4/1/09- 341 Hearing: 1 creditor showed up Got to love family feuds
    4/2/09- Trustee Report of No Distribution Filed
    6/24/09- Discharged and case closed

      IF you are just being served Lis Pendens now, you have a good 9-12 months of it sitting there before much happens.

        Good to know, cuz I'm in NY where it's about the same.
        Filed August 20 341 on September 23 Report of No Distribution - September 24 Case Discharged and Closed on November 23!!!

          Yes, you will be served, notified, etc. CH7 discharged their ability to collect on the money BUT did not remove the lien nor your name from title. Doing the latter is a separate process under a separate law that is not to be construed as collection.
