Will Wells Fargo follow Suite with GMAC,BOA and JPMorgan???

    Will Wells Fargo follow Suite with GMAC,BOA and JPMorgan???

    What is your thoughts if Wells Fargo will follow Suite with GMAC,BOA and JPMorgan as far as halting foreclosures till they get their Docs re-examined.

    We Have Wells Fargo, in FL, Last Payment about 13 months ago. Wells attorney just sent just Issued NON MILITARY AFFIDAVIT WITH DATA MANPOWER ATTCHD

    I assume in the next month or so will be getting a notice of hearing for Summary Judgement.

    The longer we can stay here the better, ( saving up money)


    We were Chapter 7 Surrendering the Home
    Filled 5-2010
    7-2010 341 Meeting (Chapter 7 No Asset)
    8-2010 Discharged/Case closed!

    I have been trying to look into this latest announcement by some of the biggest mortgage lenders(and foreclosers)....I'm not sure this 'delay' will mean too much to many of the homeowners in the FC process. I have a feeling they will only temporarily delay those that are either right at the hearing for SJ, or just a week or so away from the Sheriffs Sale. If you are much earlier in the process, I doubt they will need to delay anything. And of course, any delays only apply to Judicial FC states.

    Honestly, I would assume Wells Fargo would not change their schedule unless they announce so.

      my atty advises otherwise. "Meaningful Modifications" and / or delays of several years look easy. Starting a new thread on the subject.

        I read the article you refer to in the other post. Its similar to many articles chronicling all the problems with documents. I'm knee deep in this with my own FC. Am in Discovery right now, actually. In a judicial state. ...and I certainly am benefiting from all the extra time its taking. BUT, I see nothing concrete to even suggest that delays of several years look easy.... ESPECIALLY in a non-judicial state..

        I think that's wishful thinking on the part of your atty.

          I hear you loud and clear. Hubs and I just talked through it and the fight doesn't seem worth the reward. We don't really understand the firm's motivation to be eager to do it.

          Good luck on your journey. I'm going back to figuring out how to make the J work.

            I am curious to find this out as well. I have Wells Fargo in Central Florida. Last payment was August 09, filed BK7 Oct 09 (discharged Jan 2010), received Lis Pendens April 2010, hired lawyer to fight and file answers, decided to stop fighting and discontinued with lawyer Sept 2010. Now just sitting here waiting for any movement from Wells Fargo. I am expecting a notice for Summary Judgement hearing or a hearing for the Answers we filed but so far nothing. I was planning on being out in December but as it turns out, may have more time.

                Just included it with everything else. Told them I didn't want to keep it. I am still occupying the property now so they have to go through the foreclosure process to get me out. Going on 14 months now.

                  I just found out the the foreclosure mill that is handling my Wells Fargo case is being investigated by the state. Wondering if this is why there hasnt been any movement on my case.... Ought to be interesting.

                    it should be indeed, you know down here people don't understand how many foreclosed homes there are...or that our unemployment rate averages 11.9%...

                    what the banks what another house???? florida best do something....or someone best do something. i don't know about your neighborhood, but we just had 3 more foreclosed...or at least served last week. no one has been kicked out yet by the bank...we have our fingers crossed for everyone.

                      My street is pretty stable actually. Most homes sold before 2000 so I think I would be the first to foreclose on my street. Not good for the neighbors I know, but have to do whats best for me. Before I let my lawyer go, he told us a timeline would have us moving out about late November to December. We planned for that and have been looking for rental homes. Now since nothing has moved at all, I am wondering if we should just stay put until something does move in the court system. Have seen some really nice houses for rent that I wouldn't mind jumping on but if I can save another $1k-$2k I might just do that. Just for reference, I bought my house April 2006 for 190k. I just got tax assessment for $97k. Almost a full $100k lost. I hear stories of banks not taking houses back because they have lost so much value, now I am wondering if mine might fall into that category. We shall see...
