    MS Timing/Navy Fed is dumb!!

    Well I found out that MS is really quick when it comes to foreclosure and sale, glad we moved on when we did!! Discharged and closed Jan 2010, did not reaaffirm anything, decided house wasnt worth it, with 2 second mortgages. Stopped paying in June, house was sold at auction Sept 22, got a letter from Citi saying they were "forgiving" the 20,000 balance left over (thanks) problem is second mortgage is with Navy Federal and they refuse to understand that I am not paying them and that the house is gone, they keep calling to ask me what are my intentions.... uhmmm I have none. Then they threaten with damage to my credit report hahahahahahahahahahha well, I got 10 + years of damage with the bankruptcy so go right ahead!!

    report navy federal.... first to the FTC....and call your atty and let them know they are hounding you....you can either file a motion for a contempt proceeding against the violating creditor.

    depending on your state, some have different types of motions that can be filed...but your atty can file something to stop this immediately.

    "A bankruptcy discharge is an order from the United States Bankruptcy Court. The discharge is a court injunction prohibiting any attempt to collect on a discharged debt. Creditors are strictly prohibited from contacting the debtor by mail, phone, or otherwise; filing or continuing a lawsuit; attaching wages or other property; or taking any other action to collect a discharged debt. A creditor that violates this order is subject to contempt of court and may have to pay damages and attorney’s fees."
