I received letters from a couple of realtors indicating that a NOD had been filed offering their short sales services to help avoid foreclosure. One even gave the precise date of the alleged filing (8/26) and included a timeline as to when the trustee sale would take place. They listed Christmas Eve as the date of trustee sale.
I have not received a NOD from Chase, and the company with whom I'm working on the loan mod tells me they checked a tracking system they have access to and said they couldn't find anything.
I checked the local county recorder's web site, a NOD had not been filed. I'm not sure who to believe. I have received offers for loan mod services over the last few months but this is the first time someone actually indicated a NOD was filed. I find it odd that realtors would contact me unless they knew for a fact the NOD was filed.
I have been told it is possible that they filed even if we are trying to negotiate a loan mod, but since I haven't received a NOD it appears they haven't filed yet. Would appreciate advice on what I should do to verify. I am reluctant to call Chase directly because I don't want to alert them.
Wouldn't Chase have to send me a NOD or warning that they were about to file a NOD before they filed with the local county?
