    Locks punched out and replaced on vacant property still in YOUR name...?

    We are in the process of a successful negotiaion of a Short Sale. The bank has agreed, and inspection came back fine. Ownership is going to be transferred on August 16.

    Today, we drive by the house (we moved about 6 weeks ago) to turn off the sprinklers since part of the lawn is dead anyway and leave the mail keys for the new owner.

    Well, the locks were replaced and we couldn't get in!! I called chase and after 1 hour, finally spoke to someone who said our house was scheduled to foreclose on TOMORROW! We never even received our NOD! What idiots!

    They have already approved our Short Sale and it is all but a done deal so I can't figure out why they would do this. All they could tell me is that "based on the time you stop paying, this is when the forecasted foreclosure date is, however when you decided to try a loan mod (never did) then it was stalled and the NOD was never filled."

    So beware. CHase has no clue. I feel sorry for them.

    My mom has been worried that we could have to leave our house without any warning such as situation like you stated. I told her they have to follow the laws for foreclosure and we have to have our automatic stay lifted first, then the NOD, and then the 60 day timer starts for our state. Now I read what happened to you and I am wondering...I had planned on starting to move stuff out once we got some communication with the bank (BOA) but so far (4 months late on mortgage) nothing yet.
