Appeal foreclosure?

Does anyone have experience in appealing the foreclosure? I live in TX and have read up on it. It seems to me that it will delay having to move out of the house which is what I need to do. I have no income and house will be foreclosed on Tuesday. I will be filing Ch 7 soon but not before Tues. I just need more time to find employment, place to live, etc. Life is hard these days.

just because its foreclosed upon on Tuesday does not mean you must move out of it that day. How far behind are you on the mortgage and what does your state/area list for timeframes for foreclosure? Sometimes people get to stay 3 months - 12 months + after a foreclosure takes place, it all really depends on if the bank buys it back or if someone else purchases it. How long of a timeframe do you think you need?

I dont think any delay tactic is going to help you at this point other than Bankruptcy to put a stay in place.

I'm about 12 months behind. I've already been given notice of the foreclosure. In Texas you can be asked to leave (evicted) very quickly.

wow!..that strikes me as along time (12 months) already to go without paying in Texas.?
Texas is generally considered one of the fastest states to FC.

I'll bet even in Texas judges would give 30 -60 days to vacate.

No judges involved unfortunately. And yes 12 months is a long time. Long sad story. Now it's two job losses and nothing to negotiate with.

did you get to save any of your mortgage payment that you would have paid for the past 12 months - had you paid it? That should help somewhat if you did...

Good luck to you - job losses are hard - been there, done that.
