    Deed in Lieu after CH 7 closed and discharged

    My Chapter 7 was discharged closed a month ago. I included my mortgage in the BK. I did not reaffirm the mortgage. The home is not yet scheduled for foreclosure. I want to move to Texas soon for a better job and do a deed in lieu of foreclosure. EMC is the servicer and they will give "moving money" if the deed in lieu is approved. The paperwork asked for last two paystubs, last two tax returns and hardship letter.

    Why do you think they need this info. I just wanna do a simple deed in lieu and speed up the process. I think this alternative would help the bank by saving foreclosure expenses.

    What should I do? I think the "moving money" is in the $3000 range. That would be nice but I am hesitant to give all their required financial info.

    I think if you just want out now deed in lieu is a great idea. We are in the same boat and will be asking Wells Fargo for a DIL also. Please keep up updated and let us know how you go!

      After a big hassle working my way to the deed in lieu/bk department I was told by EMC that I cant do a deed in lieu since the home was included in the bankruptcy.

        I'd check again. Why would a lender pursue foreclosure that can cost tens of thousands of dollars instead of a deed-in-lieu? I don't get it. I'm post chapter 7 discharge (Dec 09). I'm still in the house and Wells Fargo has shown no interest in foreclosing but they are talking to me about a short sale.
