This is all I can tell you: To me, it does not sound like the plan you talked about with that agency. I could be wrong, but if you want to avoid foreclosure, you may want to check it out. If you can do this plan, and get back on track during it, you can put off bankruptcy until you can afford it, or have the time to sell your house maybe. If it cant help, sorry.

Have you recieved the ACT 91 notice yet?

Act 91 of 1983 - Homeowners' Emergency Mortgage Assistance Program

    Introduction
Thousands of Pennsylvania families faced with the possible loss of their homes through foreclosure have received help from the Homeowners’ Emergency Mortgage Assistance Program (HEMAP). This unique program, created by Act 91 of 1983, is the only one of its kind in the nation. HEMAP is a cost effective means to prevent homelessness among Pennsylvanians. By giving assurance of steady mortgage payments, it allows homeowners to seek alternate employment, job training, and/or education when they need it most. The program is funded by State appropriations and repayment of existing HEMAP loans

Thanks very much. I believe that was something I looked into when I first got the threatening letters from the bank, but I did not qualify because of my situation (no job, too much other debt, no money, whatever). I will investigate it again as I don't remember everything I've looked into.
Well, when you're married, you'll understand the importance of fresh produce.

Thanks - you mentioned this in another thread & I just left an updated comment there too.

Turns out even though I am not eligible for a HEMAP loan just applying for it puts the brakes on the foreclosure process before it starts. I met with a "credit counseling" firm today that handles HEMAP applications. They said people with no hope of approval file anyway just to delay foreclosure. This could be a big help to me to try to buy some time. So thanks again.

Fingers crossed there won't be some other surprise about this that I didn't know about (seems like almost every time I learn about something there is some wrinkle that comes up that reverses whether it is a good thing or a bad thing).

Good to hear it may help, even if it just buying time.

[QUOTE=jcraneesq;431758]If foreclosure has recently started, you should hire attorney ASAP.

              1. If RESPA or TIL violations, Section 6 may permit you to rescind the loan and receive all payments you made back.
              2. If a victim of predatory lending, you might also be entitled to such relief.

Can you explain more about what these options are please, and how to determine if they apply? How would one prove predatory lending? And wouldn't it require $ for an atty? If so, how would one get an idea if it was a "profitable" option? Our 2nd is 40k, so I am curious if legal options would be more than just trying to settle the balance with the lender. Thank you!
