    Leaving House and moving out of state...

    I've read a lot of the topics on here, and they have really provided me with great insight on to the timelines and such of this experience...

    But I was unable to find one that fit my circumstances... so please provide feedback if you may be able to shed a light...

    My wife and I have not yet declared BK, but are in the beginning stages of doing it. We have a first thru PNC and a HELC from Chase that are both past due... Chase has threatened and called, but PNC continues to try to work with us on modifications...

    We have decided to move out of state and walk away from the house. Since we haven't filed BK yet, these questions came to mind:
    1. will walking away before filing have any effects on the process?
    2. a realtor friend wants to short sale the house for us, saying he will contact PNC... but since there is a second, it's a moot point right?
    3. do I call PNC and let them know we no longer live there? what about chase?

    From the advice I got from an AZ attorney, he said I should file in my new state, so that is why we haven't filed yet... We are actuallly moving out in the next week or so... Just looking to get an idea of what my next step should be.

    1. You will still be responsible for the property maintenance including mowing the lawn until such time as the property is foreclosed and sold at auction. You would need to have someone keep an eye on the property and mow it every so often. If you don't you could get a notice from the city/county. They will mow it for you at a very inflated price.
    2. Don't know about short sales.
    3. Yes once you do move out I would contact them and let them know. Again remember you are responsible for the property until the bank takes actual possession via foreclosure and the Sheriff's sale. We had to keep our insurance until the Sheriff's sale date per our insurance agent but I called their office once I had the date and told them to cancel on that date and converted the remainder of our policy to rental insurance.
