    How long does it take to foreclose in Illinois?

    I have a mortgage with Wells fargo in illinois, im late on my june payment, probably wont make it and the july payment till 1st week of august when i can pay both June and july on the same day due to getting my normal paycheck and my semi annual bonus that will get us out of the hole.

    Do i have to worry about getting foreclosed on or any extreame fines or fees besides the standard $60 extra per month if your past the 15th? Im freaking out over here.

    No, you're nowhere near getting foreclosed on? Foreclosure is a LONG process, as in 9 months at best. My last payment was in April, and other than phone calls, they've done nothing. The late fee added on to my July statement I recieved was $140. So, yeh, it's a pretty hefty fee - but in reality, you're fine. Two months late is no big deal as long as you can bring it current in August.

      In IL, the shortest from date of filing FC suit to date of FC sale is 7 months. The average is 8 or 9 months. Tho some are hitting a year or even more depending on defense effort and use of an attorney.

        Our mortgage in Illinois is with Bank of America (was with Countrywide) and we are STILL waiting almost a year after we were served with notice of the foreclosure. We vacated house in June 2009, were served with notice in early September 2009. It finally went to court in March 2010 and our sale date was set for March 24th, then postponed to April 7th, then to April 14th, then to May 12th. BofA decided May 7th to say cancel with no further sale date then decided May 8th to no longer protest the sale. Because we got kicked out of the system, so to speak, our next sale date is set for SEPTEMBER 15TH!

        I'm sure every lender is different but we notified BofA June 4, 2009 that our house was vacant and we wanted the foreclosure to proceed as soon as possible. When I called them May 7th to see why the sale was cancelled, they said "The mortgage is in workout." WHAT?

        Now a State of Illinois issue (and this is a doozy!) The people whose foreclosure was filed immediately after ours - ours is 09 CH 31__ and there's is the number immediately following ours - somehow their paperwork got screwed up to reflect OUR real estate PIN number and NO ONE caught it. So July 3rd, I see on realtytrac.com that "our home" was sold at auction June 30th. But when you cross reference all the information on various Will County websites, it is OUR home, OUR address and OUR PIN number filed with THEIR case number showing a sale date of June 30th.

        I emailed the attorney for BofA handling our foreclosure (we are not represented as it was not reaffirmed after Ch. 7 and we don't want it) and have heard nothing back. So my real question is - did my house sell at auction on June 30th?????? I know in Illinois the judge has to affirm the sale but if it went this long slipping through the cracks, whose to say they'll catch it at the affirmation hearing??

        Long story short, Illinois is a MESS - especially if you are in Will County!!!

          Yeh that is a doozy!...I also have a BofA mortgage(formerly a countrywide loan) in FC...
          In your case I think I would attend the the hearing where the judge will affirm the sale.
          At least bring some proof that the Case # does not match the property address FC'd on.
          What happened to the other house (case # listed next to yours)?
