I agree...28 months...wow! I hope mine takes that long. When we modified our ch13 to surrender our home in May, my lawyer said we'd be gone in 60-90 days...yeah right! We're in that window now and haven't received the relief from automatic stay or NOD yet. I guess realistically we probably have at least 6 more months here.
    CH13 filed 5/21/09; 341 6/17/09; confirmed 7/14/09]
    Discharged: 7/25/12

It's really hard to say why BofA hasn't filed the NOD on our house yet. We figure that since our Chapter 7 was discharged and have no personal liability, the first mortgage is not FannieMae, FredieMac, or FHA insured that might have something to do with it. There is also no PMI so BofA is on the hook for all of it. Just a guess. The balance on the 1st and the HELOC is now approx. 900k while if we were to sell the house today it might fetch 525k. Maybe they just don't want to recognize the loss. It's also Southern California. All I know is we feel lucky to both have good well paying jobs and have been able to save up a pretty nice pile of cash in the meantime.
