Foreclosure after Chapter 7

Good Morning Everyone,

My wife and I filed bankruptcy about a year ago and included our house in our Chapter 7 bankruptcy. We are currently still living in our house while the forclsoure process happens. We recently recieved Motion for Summary Final Judgment of Foreclosure and Taxation of Attorney's Fee's and Costs and it states that it was just filed with the courts. Do I need to respond to this by calling my bankruptcy lawyers or since it was discharged I don't have to respond. Also does anyone know how much longer I will still be able to live in my house before Auction? I live in Florida if that helps. Thanks your feedback!

Your county should have a website you can plug your name into to find your case, dates etc. (Clerk of the court civil) My guess is that you are fairly close to needing to be out. Summary judgement will be granted most likely and then they will come back and schedule the sale etc. You can keep track of the the process. You are down to weeks once the sale happens (enough time to appeal the sale etc).
