Is second mortgage lender able to foreclose even though debt has been discharged and they have no lien recorded against the property on the public record? Are they able to record it at this point? I were to think that they would not be able to since that would be considered a collection action on a discharged debt and that would be illegal under the bankruptcy code. I were also to think that their threat to do so is illegal; wouldn't you agree?
