Two Questions

1. Wells Fargo filed forclosure 2/8/10. Because I finally got a job but its $8k over median my atty said to file BK next week. How will this effect when I have to move? I was really hoping to ride the foreclosure out as long as possible. Will I have to move upon discharge? And how long until discharge? Ok, maybe that was more than one question.

2. In the last six months I've either had only unemployment or below the median income but starting Monday, as mentioned above, I will be making $8k annually over the median. The job is temp to perm so technically its only temporary for now. Will I be pushed into a 13? Could they? Would they?

I'm scared and stressed right now. Thank you for any help.

i think a lot depends on what state you are in..but the bk should have no relavance to the forclosure time period.. some states it can take up to a year..and the timing of the bk can help you if you do it right....

The means test is backward looking, that's why you need to file before end of month, however, you should check you income for past 6 months, you might still be OK for an April filing.

Since job is just temp, you still have a good case for budgeting based on your past income rather than looking forward.

Your ch7 filing will slow down the foreclosure, and the foreclosure may extend your ch7 for a while.
