We filed chapter 7 and was discharged in Oct 2008. We told the court that we wanted to reaffirm on our home but never signed an agreement according to my court file. B of A has listed our mortgage as closed and filed/discharged in Chapter 7. Our payment went up this year due to rising insurance cost, a 25% increase which we have to make up in escrow leaving us to struggle. We were barely making it before now its even more difficult. I have called B of A and spoke to every source available. NO HELP! Are we legally liable for our home? I don't want to walk away but what bnefit do we have staying. They won't report our payment history or assist in anyway. I just don't want to pay for a mortgage for 30 years I get no benefit from. Thanks!

Since your debt was not reaffirmed thru your bankruptcy, you are not liable for any further payments and they can not come after your for any deficiency. If you are set on not paying anymore, just ride it out and quit paying and live rent free for as long as you can to save money!370K Secured Debt / 53K Unsecured Debt
