Here's another insane story for you all to enjoy
Homeowner applied for modification back in early 2009.
Over the next year the lender goes back and forth with all of the games.
Send the docs and the lose them/didn't get them
Resend the docs and they still didn't get them
Month after month no response on request.
Last Friday they mail a letter denying the modify, saying the HAMP analysis did not work. Homeowner has 30 days to request a review.
But the sale of the house may (or may not) be set for sometime next week and they won't delay. They had previously served both NOD and NOS so the legal rules are met.
But they still cannot explain why on the one hand the HO has 30 days for a review request but at the same time they may sell house in 7.
Depending on who is to be believed the sale is either the 9th, 10th or 13th and is either pending or on hold.
Client doesn't want to do a BK so if the lender insists on being dumb and selling house (massively underwater) then there isn't much to do but how stupid is this.
They are also working w/HUD but not sure what they can do either (other than have the oomph of being the government)
