We own a house out of state (we have a mortgage that we stopped paying last June). We got our certified letter from the sherriff but it has not been auctioned off yet. Our attorney's secretary made a face and said she doesn't know what to do about this since the house is out of state. She is talking to the attorney next week- he is out till then. What is the worst that could happen to us? I am anxious to get this done but I won't be able to relax until I know.

Why is the secretary confused? I'm not sure what the issue is. We owned property that was out of state and waited for it to foreclose before we filed.
My advice is that if you intend to let the property go, then wait for that to happen before you file. It significantly simplifies the process and doesn't introduce a 90 day delay in the inevitable.Case Closed > 2/08/2010
