    1st Written Communication from Mort. Co. - What is it?

    Background: Filing ch 7 in summer when we are under median. Dumping it all! Car, house and cards! Haven't paid mortgage (citi) since December. They've called us but the first letter came today. I'm trying to figure out how "official" it is so I can attempt to plan to be out if it's going to be sooner rather than later. Our attorney advised us that we will have to be in a rental at filing for "expenses going forward."

    The letter says:

    "Your account is in default."

    "As a result of the default status of this account and in accordance with the terms of the Mortgage Note/deed of Trust...an exterior inspection of the property will be done..."


    Is this my official Notice of Default? It seemed like it would be a more substantial letter. Does the foreclosure timeline for my state (Missouri) start now?

    I got this same notice about 2 weeks before the "official" NOD. They actually came out to inspect the house! The NOD will then come via certified mail (and in my case also regular mail ... identical copies). Within the NOD there will be a date set to pay your entire balance. After this date passes they will send another certified letter informing you that a foreclosure attorney has been assigned to your case; and, you will have a sale date. The timing of all of this depends on your state. I'm in TX.

      This was my time frame (NV)

      Quit paying April 09
      June - Friendly letter saying you're late
      July - Less then friendly letter saying you're late
      July/August - Letter saying case referred to Attorney
      October - Notice that they were asking BK court permission to come after me
      November - Hearing date (did not attend)
      December - Filed docs from said hearing
      January - NOD
