    Being sued by the wrong bank?

    Here's the short history: I have 2 investment props that haven't had a payment made on them since June 1, 2009.... BOTH with BOA....

    I'm rounding 3rd base on finalizing the foreclosure on Prop 1 as I have a sale date of 2/23.....

    I had never been served on Prop 2 at all..... I was upfront with what was going on with tenant a long time ago and they mentioned someone left a card in the door with the logo of "District Court of _____ Officer" on it.... all official looking but it was simply someone trying to serve me. Which is funny, because I'm not hiding - my mailing/home address is real clear on the account and Prop 1 was able to figure it out, but I digress....

    So I searched courthouse records and sure enough there was the 2nd complaint (Prop 2) - I opened it up and noticed that the plaintiff is Bank of New York Mellon...... that's not who my mortage co is.

    I'm thinking that BOA's atty just screwed up the complaint and put the wrong plaintiff on the case.... I have never had 1 item ever that referenced Bank of New York Mellon (i.e. new servicer, loans been sold, etc.).

    Is anyone familiar with a servicing/mortgage/anything relationship between the 2 banks?
