Sometimes it takes longer. I am in my 21st month of non payment on my HELOC with no threat of suite andlittle collection efforts. They did send me a joke of a modification at current rates with all missed payments added into the same ballance.
I was tempted to copy a recent apraisal and send it back with the unsigned mod with a post it asking "What would you do?"

      I LOVE this idea!

Also, I think we will be able to settle soon, for a couple of reasons: first, this is no longer a zombie loan; the loss HAS been written into the books, so any settlement is now a net gain for them, rather than admitting a loss. Oddly enough, this somewhat counterintuitive accounting trick is responsible for a lot of non-settlements.

Also, the bankruptcy discharge gives them an added incentive, because they have no other way to get money; in other words, the delusion of collecting on assets cannot be maintained.

      We'll see.

who carries your 2nd ?? I believe I'm in my 5th month, and it looks like they finally stopped sending statements. oddly enough, after my discharge, my Heloc showed on my credit report as "Paid in Full" with no delinquencies.
