Reason I'm asking is I plan on stopping payments to them post Ch-7 discharge and trying to settle. I have heard since their a foriegn bank, they haven't been participating in any modification programs

I have a HELOC with them. Back in July when I thought I had some equity and was trying to refinance I asked them to reduce their rip-off rate from 9% variable to 5% they said they did not have any program to help me. Guess what, I stopped paying last month and they started calling and sent me letter about some programs they have that could help me becoming current. Now I know my house is underwater based on comps. They can foreclose if they want to because my soon-to-be-filled chapter 13 will be based on modded 1st and no HSBC's HELOC or equivalent rent.
