    Just wondering can I do a short sale if foreclosure hasn't started????

    I haven't heard a thing about my property and the last I heard was that the stay of relief was terminated and the trustee didn't respond at all in the paper work. It's stated as trustee no response. I am hoping I find something out soon. Hopefully by the end of February. If it takes longer than that could I do a short sale? I don't even know if that would be a legal issue or not. Any input would be great.

    Somebody else may correct me, but I can see no reason for you to do a short sale if you are going to be discharged in BK and you are not re-affirming.
    It would just be another hassle for you to deal with. You would have to negotiate with the bank and the potential buyer, go to a closing, etc.

    The only reason I could see that it would be beneficial to you is if you are having to pay HOA fees, because the bank won't foreclose.
