    How much longer.....

    ... so here is the time line

    10/08 - Filed BK (didnt reaffirm on the house)
    12/08 - stopped paying on house (first and second mortage)
    1/09 - bk closed, no objections
    7/09 - was served with papers stating wells fargo intention to forclose in august 09
    12/09-received a fed ex stating that there is a hearing on 1/10 about forclosure....

    does anyone know how much longer it will take until the properity officially forcloses on? It's been over a year since a payment has been made.

    Your question is like attempting to predict the future. It depend on the branch or location of the mortgage holder.

    In any case, once the house is sold or repo'ed, you will have at least 30 days and longer if you refuse to leave. Then they must sue you (a simple suit for eviction) and you will have at least 30 more.

    Start looking for your alternative, but do not become dismayed. It is all part of the system and your new start has started. Just "handle" it. 'Hub

      I moved out over a year ago so I guess I "handled it"... I just can't believe how long it takes to forclose on a properity

        These threads always amaze me. I see people that haven't paid in over a year, yet when I am 30-60 days behind on my payments, I get nasty letters stating that my mortgage company is going to foreclose on me!

          Yes, they love to threaten. Sometimes people get scared and actually pay. Even when they shouldn't.

          It's been a year almost to the week for us. We received the NOD in November, 11 months after last payment on 4k per month. We moved a few weeks ago. Not because we had to, but because we had purchased another home.

          Lender has not asked for Motion To Lift Stay, either. Attorney says we may be in for another year or two, in terms of wait time. We are with BoA in Florida Middle. Long lines at the foreclosure desk here.

            Thanks for posting. My first post here but been lurking awhile. I too am in Florida Middle and stopped paying mortgage 8/1/09. Filed BK 9/28 and discharged 1/5/10. Lender requested lift of stay on 12/23 and it was granted. Only thing I have received from mortgage company is a letter to call and see if I qualify for the HAMP program. I did not reaffirm and its my intention to let the house go as its 60% in the hole. I am hoping to stay until at least August to save up money to move, but from all the reading I am doing, it seems I maybe able to stay quite a bit longer.

            How would I receive a NOD? Would it be stapled to my door? or delivered via mail?

              If your mortgage was included in your bankruptcy (as mine was) you will probably just receive a NOD via USPS, or perhaps nothing at all. I didn't receive anything and did not find the NOD until I checked my County Recorders website. I have not paid in well over a year, NOD filed 09/23/09, still no notice of trustees sale. I moved out and just want the house sold, but as stated by many posters, Bank of America "sits" on these houses for a very long time and just leaves you in limbo. They will actually get real snippy and tell you that "You can't make us foreclose" if you call their customer service line..I'm thinking I just may move back in and cruise rent-free for a while again..If they don't care, I sure don't..

                Mortgage was IIB. Just checked my county records and nothing there either. I plan on staying as long as possible cause every month gone by is about $2k in the bank. My loans are serviced by Homeq and I believe Wachovia in the lender but not sure. No idea on how quickly they move....wish I could find out.

                  I think the county website is great. I can tract what is going on and am using it to gauge when we need to move. Our home is with GMAC and I went back and looked through the foreclosure calendar for other GMAC homes and looked to see how long from service date to sale date. Most took a long time.

                    I stopped paying in June with Wells Fargo. My atty told me to ride out the foreclosure. A few weeks ago I got a letter that my restructure didn't go through. Because I didn't pay anything. I haven't heard from them since. I was considering a short sale to stretch this a bit further. Why are people filing BK prior to forclosure?

                      BOA taking forever...me too!

                      Hi all,

                      Our home was surrendered in Ch7 and discharged Sept. 2008. We moved out July '08 per attorney and it has sat VACANT ever since.

                      March 2009 no NOT sale still and Obama in so asked about workout?? Finally heard something Aug. 2009 got a workout pkg in mail. They tacked late payments on the back and lowered and fixed interest rate.

                      I didn't reply to workout pkg as house was vacant and discharged and not sure they should have given it to us.

                      Home continues to be postponed week by week or month by month at auction. No one knows why. Even my "forclosure tech" has ben unable to fix it. There is sits...vacant...and I am renting 3 doors down! Thinking about moving back in...live rent free until they do something. Problem is...in a contract here in this rental. And my luck is we move back in and it FINALLY sales at auction. ahhhhhhhh!
