    morgage company filed a relief and abandonment on our property

    I am not sure what this is and what we need to do about it. We have a bankruptcy lawyer and are currently waiting discharge. We filed in Sept and had our hearing in October.

    We are fighting to keep our payments up to date and they currently are.

    Can we fight this or are we going to lose our home?

    Did you file Chapter 7 or 13?
    Did you reaffirm on the mortgage and have signed papers stating such?
    Are you current on payments?
    Do you have a lot of equity in your home?

      If they filed a relief and abandonment motion on your property, they are making it clear they are going to forclose. Call the mortgage company, tell them you want to keep your property and ask to sign a reaffirmation. If you are current on your mortgage, I'm not sure why they would want to forclose? Strange.
