    Dreaded Wait
    I keep thinking i must have missed something in the mail or maybe they will be springing the eviction notice any day

    So far I have gotten a notice of Intent to Forclose by certified mail.. that was 2 months ago

    I was advised by others on this board to look to move as soon as i get notice of the sale because that would be 30-60days before the evict notice

    I was expecting that I would recieve a letter saying the sale date..

    I heard from someone else that they just recieved an eviction notice and that was that

    Now, this is just me and I prepare obsessively.

    I would simply call the bank and see what's up. Chances are that in Nevada they are SO backed up that it is taking allot longer than normally would. If so you have more time to plan and at worst you can plan what to do without the stress and strain of having to do it quickly.

    Not knowing what is going to happen is the worst of it because you cannot plan.

    Are you planning on leaving anyway?

    Do you want to try to modify?

    If so have you started getting your paperwork ready?

    All the advice I get and hear is to be in contact with your lender. I call Wachovia EVERY week asking when I will be out of the BK department even though I know the answer already and I always ask the same questions about their modification programs. I always get the same answers.

    Maybe it's just a mental soothe for me but at least I know I won't be getting any surprise notices.

    Again, that's just me.

      I just recieved notice on my front door
      "notice of default and election to sell under deed of trust" (dated 11/13/09)

      ironic that i just posted my question.. anyway

      yes i plan to leave .. making the best of a bad situation .. waiting till the last min. so i am not responsible for property and i have an oppertunity to save a little

      the top of this letter says Recording requested by
      ** service company
      they are the trustee assigned to us i suppose

      now i wonder how long from here

      anyone else get this letter?

        I couldn't take it anymore.. i called

        the NOD was recorded in November
        they said the "PrePub" date is in Feb

        they didn't know the sale date but said that after the prepub date notice would run in the paper for 3weeks then the 4th week would be the sale



        I would like to know the actual sell date and how long to expect to have to move after the sale date

        But I feels a little better .. some info

        I think I should plan on moving during the "prepub" time..

        its a shame it is just 2 months before school ends..

          My NOD was recorded 9/23/09. Sale date scheduled for exactly 90 days after that (12/23/09). My publications have already started. Be prepared for phone calls and stuff from various "vulture" loan modification firms, offering to "save your home"...I just tell them, No thanks, "Is there anything I can do to speed this process up "? I am in Southern California. Personally, I can't wait for this to happen, so I am finally free. Once you get over the emotional aspect, it's not too bad. I rent for half of what I paid and live basically debt free. It's a nice feeling. Plus, I get a real kick out of the idiots at BofA who call. Threats just don't seem to work anymore..Just one more vacant house to add to their collection... Plus I should have added that although I have already moved out, at least here in California you have 30 days before eviction..

            Dont want to hijack but have a question for bulletproof... you have your mortgage with BoA? When did they send you your NOD? Im getting ready to miss my 3rd pmt with them. Im so nervous. We really wanted to keep the house but just cant make it. Lawyer and realtor both advised us to forclose. Realtor told us she could probably only get 150 for it, mort is 170. Im so humiliated and I hate doing this so much. How much time do you think we have to stay here and how hard is it to find a place to rent with screwed up credit? We are hoping for enough months to get things packed, find a place, and save up enough for a few months rent.

              I was with BoA. I quit paying in Jan. 09. Received NOD in October.

              Filed BK last week.

              In our area, Florida, my attorney says we may have 2 more years. This varies by state and luck. In our case, we are hoping BK will speed things. Attorney says not to count on it. However, they will probably file to avoid the automatic stay. If they do so, that may start the wheels spinning faster toward finishing the foreclosure.

              I can hope.

              Either way, itis hard to predict what will happen for you. I do recommend opening a thread of your own, with appropriate Thread Name, so that others can better answer or try to.

                Quit paying 12/2008, received "real" NOD 09/23/09, sale scheduled for 12/23/09. BofA mortgage, moved out (left place clean) and rented for HALF of my former mortgage payment. SCREW Bank of America, in house "mods" and HAMP is pretty much a joke, tried it all. I'm free now..(Filed Chapter 7 BK 03/09, discharge 07/09)...And STOP feeling bad about it, it's just "business in America"...If the numbers don't work, WALK AWAY (and it's NOT hard to find a place to rent-with 1/3 of the nation behind on their payments or in foreclosure, it's easy to find sympathetic landlords)

                  thanks guys. this one is just a hard pill for me to swallow i guess. i talked to my realtor again today and she said no way could we sell as we would be upside down 35 g. she said she would get us in a rental no problem. we will miss our third month now and i guess we will wait and see.
