I was recently discharged from a Chapter 7. I have both a first and second (HELOC) on my house. I stayed current with both payments but did not sign a reaffirmation because Chase (first mortgage) didn't provide one and I wasn't about to sign for the second without the first.
My attorney's office received an email from an attorney for the second leinholder stating they are going to start foreclosure proceedings even though I am current. Can they do this in Ohio?
Also, to make things more confusing my second may actually be in first lien position as their lien was filed a year before Chase's lien.
My attorney is out of the office today so I don't have her take on it. I'll be really upset if they can take the house even though I'm current on my payments.
Anyone have experience with this sort of thing?
