    Peoperty TAx during the Ch-7 and Foreclosure.

    Hello Friends

    Our house is in pre-closure status since Sept 21st of 2009.
    No idea how long it will take to get the Auction date (MA state).
    We filed ch-7 surrendering the house. Done 341 meeting and discharge date is 11-23-2009.

    We owe the property tax since 1 year. Now the City is demanding the property tax by Dec 31st 2009 and the City is going to publish our names in the City hall and local news papers.
    We are planning to stay in the house till the last day of the foreclosure. If this last day comes after couple of months, what the tax department is going to do?. Will they take us to the court for the past due tax or will they demand for the payment after we move from here to other City or other State?
    Do we have to pay the property tax? What is the procedure?

    I've owned several properties where I was unable to pay the property taxes. Each time they were due, the mortgage company paid them. I assume they didn't want the property to be sold at the tax sale. They paid the insurance too but not the HOA dues. So no worries with your BK because probably the worse that would happen is the county sells the property at the tax sale.

      Land taxes go with the land, not the person. When you file, the automatic stay will protect you over all this. As far as your name published, who cares? How many people really read those legal adds. AND if anyone does re; you, they best not cast stones in glass houses, they could be bk very quickly in this economy. 'Hub

        What is the difference between Sheriff sale and Tax sale?

        2 months back my Mortgage company (WF) sent a letter to pay the past due property tax. I did not pay. In this situation will WF pay all the past due tax?

            Yes, WF will pay even if you don't already have an escrow account established. WF will pay your past due taxes and the current taxes and establish an escrow for the house - even while you are in foreclosure. This amount gets added to the amount you owe WF (along with attorney fees etc). If you are surrendering the house, it will not make any difference to you in your BK. Just list the tax debt on your forms in the appropriate places.

              A tax sale is tax certificates. For three years they will sell certificates on a bidding scheme. He who bids the lesser of the percentage and buys the certificate holds it. The percentage starts at 18% (in FL). Before you can sell the house, you must redeem the certificate with interest. If the house goes three years the house could be sold for taxes (and what is owed on the house if anything) on the Courthouse steps. This is a tax sale and it could be called a Sheriff sale although the Sheriff does not do the selling.

              A Sheriff sale could be a car attachment and sold at the Courthouse steps as well. This is done by the Sheriff (in FL) and other property as well. You could use the term interchangeable in your question. 'Hub
