      i think it many vary ...we also had chase...and it's been 3 years and they have NOT foreclosed....we did NOT stay for those 3 years, however, did stay 6 months and then moved, however, i do think had the deep dark freezing winter not have set in, we would have stayed until we the NOD....

        Last payment 08/2009 and I am still in the house. I should easily get to the 2 year mark. We had originally planned on leaving October/November 2010, hired a lawyer to delay the case a bit and it turned out to delay it a LONG time. There has been zero movement on my case since September 2010. Think we are just going to stay put until it works itself out. In the mean time, I have paid off a lot of bills, working on paying off vehicles, then student loans. Have money set aside for 1st/last/security on a new place, putting a couple grand into vehicles for maintenance, and then working on credit upkeep. So far so good.

          18 months without a payment. BofA. expect this has a long time to go yet.

            I can't even remember anymore, probably a year. Because I must have missed about 5 months of payments, then went into two 6 month forbearance plans with reduced payments, then bk, which gave me another set months of no payments, and now another loan mod attempt. But I did give them 20 years of faithful payments, netting them over a 1/4 million dollars profit.

              Damn. Seems BoA really wanted my home compared to everyone else. Made my last payment in July, 09. House was sold in March, 11. So about 20 months, with a year delay because I filed BK7 in March, 10. The robo-signing mess bought me a few months too.

                It has now been exactly three years since we've made payments on either our 1st or HELOC with Bank of America. To date no NOD has been filed. My company is transferring me to Dallas next month. My wife and I just got back from Texas where we just bought a new house for cash. With no debt after the BK discharge we've been able to save a ton cash over these past three years, and combined with some serious budgeting we were able to do the all cash deal on the home in Dallas. BTW it's almost twice the size of our existing home and half the price. Filing Chapter 7, while difficult to come to terms with has actually been the smartest decision we ever could have made.

                  You might want to just pay the min on the student loan (as long as you have a low interest rate), and cash up. Something to think about.

                    Those student loans are costing me $350 a month for 15 years, if I can get rid of them that is what I will do. If I don't try and do it now, it will never happen. However, It will only happen once the vehicles are paid off so I can snowball the funds into the loans.

                      slam....we have followed the same path.......and now in our new house...and still 3 years and not even a NOD....but we have Chase...not that makes any difference.

                      and, for us, as well, it was absolutely the BEST business, and life decision that we ever made.

                        Good for you guys - congratulations! Wow no mortgage on your new place.... wonderful feeling. Tell BOA to shove the house where the sun don't shine!! We felt the same way about filing Ch 7.. hard to do but once done and discharged it has changed our life, for the better!

                          Hey there Cory1848, can you basically tell me what did your lawyer do to delay your case? In my situation, I am trying to find out if B of A has filed my August 2010 NOD with my county, since they sent me a letter just this Wednesday telling me that my house is now in foreclosure. Yet I have not received any details from them in regards to what they will do next. Yet I have just received a letter from a fly-by-night type lawyer today (out of the blue), telling me that B of A has started foreclosure proceedings on my house, and he wants to help me. However I am looking to see if I can find the NOD filed with the county online somewhere, yet I know I now need a lawyer, so it would be great to learn what your lawyer did to slow things down. Yet since today's lawyer came out of the blue, there must be a public record he found of my troubles, and was able to write to me after 2 days of my receiving the B of A foreclosure letter.

                          Any help you can provide would be appreciated. Thank you

                                NOD was sent to me awhile before the LP was. I didnt think I received it either as it was not required to be sent Certified, etc. It was regular mail. After going back through all the paperwork I received, I found it. Once I was served, I hired a lawyer. Instead of filing answers to the summons right away, he submitted a motion to dismiss based on the fact that a security was not allowed to foreclose because they technically don't own the note. It is a delay tactic because eventually the law firm will come up with the correct paperwork. They should have filed it correctly in the beginning so I have no issues making them do it correctly. This alone bought me 6 months. A heading was set for the motion to dismiss and the day before the hearing, my lawyer negotiated with the law firm that was suing me that if we were to drop the motion, they would allow us the original 20 days to file the answers. We agreed, and 2 weeks later filed the answers. At this time, I decided not to pursue the case anymore and let the lawyer go. He signed off and that was the last record recorded. That was October 2, 2010. Nothing has happened since.

                                You will receive a lot of letters from lawyers wanting to help. Some are legit and some are bottom feeders. DO you research before hiring anyone. You are receiving those letters because now it is public record. Not really out of the blue, the bottom feeders search those records everyday and send out info once they find something.

                                I kind of got lucky in the fact that timing played into my case. The law firm that is handling my case for the bank is now under investigation for fraud from signing all those foreclosures with bogus information. Since that has happen, everything has stopped. Good for me, bad for people wanting things over with.
