DJ, you're asking us to mind read without information. I assume you did not reaffirm your house and are discharged???? Then they must first sue you, (call your debt) and go through legal paper to evict you. I would say two months plus. but really, this is a guess without more info. 'Hub
If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

Well, you moved out? Why the question about how long? For one thing, they could do nothing at all while the automatic stay is in effect. If you stop paying they can foreclose and ask the stay be lifted. You would have plenty of warning time though. I'm confused as to the reason you are concerned? 'Hub

I no longer live there.I see people saying it is taking a year to forclose....that is my concern.I'm still paying the hoa and electric bill. Like i said I have not made a pymt since May 09. I don't want this to go on for a year.

Hi. I'm in CO too, I filed in Feb but I was already 1 yr past due on pymts.. they haven't even taken the property yet if that says anything. I would say you would've had til probably may 10'. I moved in Jan b/c I thought they were going to speed up the process after they pulled on the automatic stay but it actually took them longer.

Well since I moved, I just check on it once a month. The first publication just happened for an auction so the eviction is about to start. I called the bank long ago and told them i've been gone but they said they have to go through their foreclosure steps.

No payments since 12/08, and STILL no NOD....nothing..just sits. Of course, you can't give away a house in Southern California..in the High Desert , builders are demolishing unsold tract homes, it's ridiculous.

If they put a lien on the house for past due amounts, then they'd most likely just wait for the bank to foreclose, at which time the bank would pay them to clear the title.
