Has anyone here had a Forensic Loan Audit done???

    Has anyone here had a Forensic Loan Audit done???

    My question is twofold. I want to have one done, but I haven't been successful finding anyone that has had one done or that can recommend a good company/lawyer who does them.

    Are they are waste of time and money? I just had to file Chapter 7 on Monday to hold off the foreclosure sale on my home and now I'm seriously thinking of fighting this foreclosure using a forensic audit and/or QWR to see if there are any violations, etc. to save my home. I've been trying to sell for close to 2 yrs with no offers and I feel at this point, that I've got nothing else to lose .

    The 2nd part of my post is that I'd really like to train to do these audits and am hoping to find a legitimate school to go to where I can become a Forensic Loan Analyst and help other people like myself and those on this forum. I'd appreciate 'referrals' to schools and/or training that you personally know to be legit and especially have used yourself or know someone else that has.

    What exactly do you hope to accomplish? The best you can hope for is to delay the inevitable for a few months, and it will cost you a lot of money to do so. If you think the lender is going to end up canceling your loan and giving you the house, that's just not realistic.

      Not realistic in most cases--lender cancelling the loan.

      But it has happened. Very rare, but not out of the question.

      I know of one case in South Florida where the lender approached it differently though and it was sort of a split-decision.

      The mortgage document was nullified, but the underlying debt survived in the form of an equitable lien. Th result: The homeowner no longer has to pay the mortgage, but if the house is sold the entire amount is due. And they cannot escape a deficiency, according to this ruling.

      Double-edged sword in the case above. A search will turn it up I am sure, and I may have a bookmark somewhere.

      In most cases, these types of fishing expeditions result in delaying the foreclosure. If that is the sum of your goal, I say go for it.

      There are foreclosure cases by the dozens in my Florida county which have been in the works since 2004-2005.

        one thing to be aware of, since you have filed chapter 7, if problems are found in the mortgage the trustee can void the lien and take the house to sell and pay creditors. In the end you wouldn't gain anything and would be out the cost of the analysis.

          Please STAY on topic! No where in my post do I mention getting my home for FREE. I am asking if you've had a Forensic Audit done. If you haven't, probably best to move along and harass some other OP that cares about your opinion.

          Anyone else have any HELPFUL info on audits???

            Given your statement:

            I think it is reasonable to assume you wished to delay the foreclosure. A mortgage cancellation is not assured, but by the tone of your post, would seemingly be welcome.

            In any case, I referred you to a case where a forensic audit did exactly what you are attempting. Why you see no value in the response is entirely unknown to me.

                Bankruptcy, Pre Foreclosure

                Hi Tia.

                Don't beat yourself up or allow anyone else to. No one knows until they've walked in your shoes. Your story sounds somewhat like mine. I won't get into that, however I will try to address your question.

                1. Yes, there is help and a forensic audit can help you in pre foreclosure and post foreclosure.

                2. The bankruptcy can delay and depending on your circumstances and legal advice from a BKO / Real Estate attorney, could save your home. However, I would get the audit first. If there are any violations in our loan, they will be discovered and this will/can give you leverage to negotiate. Because I don't know all the circumstances and you should probably reserve that for the auditor and attorney, it's hard to say with limited info on your outcome.

                3. Time is of the essence! Don't delay on this. I lost my home because I was overwhelmed and had no one to help me. Until now. I am post foreclosure and suing my Bank/Lender.

                4. I am also “A Provider of U.S. Lender Audit™” and happen to also be a Certified Forensic Loan Auditor now for the same reasons you seem to be wanting to pursue this. To help others.

                5. I am a Certified provider for the Pioneer of "Forensic Loan Audits" and they not only do the Audit, MANUALLY, but they also have a 3 step program to affiliates, providers etc. So that should address your questions. Many auditors you see online are using software to do their audits which is a joke.

                6. There are some unscrupulous online company's out there who provide outrageous marketing schemes, and other money-making opportunity to lure in people hungry for a quick cash fix. The results; Attorneys are not auditors, they are attorneys and couldn’t provide testimony against their “own findings”. Software is garbage in, garbage out situation, and just as desktop underwriting was the key to bad compliance, audit software routinely used lacks integrity and real accountability and understanding. If you use QUICKEN to you’re your taxes…does that make you a CPA? Furthermore, ask yourself is a CPA an AUDITOR necessarily?? And, if you think auditing can be taught in course studies, think again. U.S. Lender Audit services a team of auditors that are experts in auditing banks as required annually. They are compliance auditors and still to this day work as a neutral third party that must go in routinely for the purposes of FDIC reporting and for other agencies who provide institutional inner working with the bank’s loan files. Most auditors aligned with U.S. Lender Audit have 20-30 years of actual compliance auditing they’ve done for institutions throughout the country and still do as an annual manual procedure.
