    How long do I have after discharge to when the foreclosure restarts

    We were just discharged yesterday and I am wonder if anyone has any knowledge or experience with how long before the lender (HSBC) restarts the foreclosure process. We filed just before the court date which was to set the foreclosure date so that stopped the process. Lender will have to restart the foreclosure by asking the court to reset the date for the court date.

    I hope they take their time so that we can work on a modification of the loan that we did not reaffirm.

    How Long...

    Our mortgage is with HSBC also. We have not made a payment since April 08. We filed Chapter 13 in July 08 and then converted to Chapter 7 in October 08. Our discharge was Feb 09. HSBC filed July 09. Our attorney said we probably have at least until November before we have to leave.

    We did receive paperwork to reaffirm the mortgage. They offered to lower our interest rate from 12% to 8% and add on the missed payments, making the balance go from about 195,000 to 215,000. We estimate the house would appraise for about 190,000 right now.

    Our attorney advised us against reaffirming, because then we would be stuck with a home with no equity, that needs a lot of work.

    Despite his advice, we probably would have reaffirmed if HSBC would have agreed to pay the $4000 in back property taxes by adding that to the mortgage. I was NEVER able to speak with anyone at HSBC. They would only refer me to Acorn, which would only try to get a 3 to 6 month temporary payment reduction.
