    Locks Changed-Help

    Hello Folks,
    National City had the locks changed on our house while we were in the process of moving out. The contracted with Safeguard who sent somebody out to change the locks from a company with the initials REFS. I know this because Larry from REFS put his name on a chart on wall which requests anyone entering the property to sign in. Well, anyway, good ole' loser Larry stole our computer and a coin jar we had on the computer stand.

    We have gotten nothing but the run around from National City and Safeguard, who will not tell us who REFS is. May question to all of you....Does anyone know what the initials REFS stands for??? I thought probably something like Real Estate Foreclosure Services but I can't find anything when googling that.
    Any help is most appreciated.

    I can try and search also, what state are you in? did you try REFS (your state) and locksmith or the same with repossession? these would be my first tries while searching. Sorry to hear you had this happen to you! I hope your files were backed up, I've had this happen to me (it was just a sleazy ex) and I got a pix-text a few days latter of it floating in the lake by his house--at least I know he just wanted to hurt me not steal my ID or anything. I lost so much on that computer that I now have an external hard drive that has everything my computer has and a thumb drive for school, personal, and financial/BK. I'm a back up nut now! It stings when it first happens though! I do hope you are able to track this person down. Though I wonder, if he stole all of this do you think he used his real name?
    Still learning all of this, but glad I've found this site! Thank you all for your advice and patience!

      Wow sorry to hear that. Unfortunately I do not have any info but do have a question. Did the home already get auctioned off? Reason I ask is because I have National City and do not want to come home and have the locks chnaged.

        Something is fishy. There are details missing.

        Did National City go through the process of evicting you? Have you been living elsewhere but keeping your belongings in this house?

        No one will just show up to change the locks if you are still living there. If you moved out and National City holds clear title to the house what you left there was abandoned property.

        If you were evicted, the court would have given you a certain timeframe to have yourselves and your property out of the residence.
        Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

            Same here. Where's the paperwork?

            A lockout without going through the proper channels and with the proper paperwork is an involuntary eviction. If that was done, someone's going to be in deep-deep doo-doo.

            What's the rest of the story?

              I have the same problem with Metlife and Safeguard. I had most of my belongings out. There are two beds, two desks, children's bikes, scooters and sports equipment, and yard tools - left to move. No notice that they planned to lock out. I still park a car there to make it looked lived in and go over every two weeks to clean up the flyers, yard and pigeon droppings (before they locked me away from the yard tools). HOA and insurance are current.

              Safeguard said they needed permission from the lender to let me get my things. 72 hours - I am going on 2 weeks. The house has a NOD filed with a sale date of 10/16 before I filed my petition last week which will postpone possession further.

                  The locks on my house were changed 2 weeks before foreclosure. The tenant had just left, so I guess they called it "abandoned," but is there a court process for that?

                  I doubt WaMu was checking on the house; it seems way more likely that the investor who eventually bought it initiated the lock-out. I'd really like to know what happened.

                  Was there a court order? What would I be looking for?
                  Filed non-consumer no asset Chapter 7 on 7-12-10 after 4 foreclosures, 7 lawsuits including 2 deficiencies, 2 wage garnishments, a bank garnishment and a partridge in a pear tree. 341 held on 8-11-10. Discharge 11-4-10.
