    Buying a home after foreclosure/ch 13

    I filed chapter 13 around October 2007. I surrendered the house in something like December 07. It is still not completed. I was told I can get a loan after 2 years of "clean history" after a foreclosure. Does that mean since it's not considered done, the foreclosure 2 year countdown has not even begun yet?

    That is also my understanding.

    The Foreclosure date, for credit purposes, is the date the deed is transferred back to the bank. That does suggest you have not even started the clock yet.

    More lenders are refusing to hurry with foreclosures, since they have so many properties already. With the deed still in your name, they reduce some of their liabilities in some cases. Like HOA, etc.

    There is no legal way I am aware of to force them to hurry or even to foreclose at all.

        There has got to be some legal theory, somewhere, that can allow a homeowner to force the issue; granted, it would require the homeowner filing a lawsuit in state court, but I bet something can be thought of.

        Or, at the very lease, sue the bank for damages (this might work if a person has an HOA). Granted, this would probably get dismissed in court, but it would be interesting. Probably should go pay some eager 3rd year law students to figure it out.
