    One year this month with no payments!

    I'm in Ca. so that fact and I had a chapter 7 discharged last winter is probably the reason I haven't received a NOD yet. Even though it's nice not to make the mortgage payments, I know my time will come to move.
    Plus I got divorced at the same time and as far as I know my ex is considering filing chapter 7 also (he's still on the loan)
    But I can't complain since I have a decent job and will hopefully be able to rent a decent place.
    So how long have any of you folks been living 'free'?

    We live in Oklahoma City and quit paying our mortgage in April 08. We started with a Chapter 13 in June 08 and converted to a Chapter 7 in September 08. No payments were made to mtg company. We were served a court summons today, so I think we will find something this month and go ahead and move. We were able to save a little money thank goodness. Good Luck!

      Since May 2008....

      Still here since May 2008 without payments - discharged CH 7 Jan 2009. The bank is moving at a galacial pace to foreclose.....

        No payments since March '08. Discharged back in September of last year. No NOD has been filed and have heard nothing from Bank of Amercia.

          Wow, I knew I wasn't the only one! I have BofA too Slam.I'm sure they are overwhelmed by all the mess from Countrywide!

            Last payment 12/08 (BankofAmerica/Countrywide) Discharged Chapter 7- 07/09. Divorce final 08/13/2009. I have called BofA/CW REPEATEDLY asking them to issue NOD and to get this foreclosure party started as "someday" I wish to buy another house..Ex-spouse (and new significant "other"-oh boy, won't go there-don't care) living rent free and trashing the place....Hate to see it, as this was a home I bought way before the marriage, unfortunately her name was on the deed after a refinance. First and second NOT reaffirmed and discharged, but I STILL can't get them to get off their rear ends and take it back...and yes I have offered deed in lieu etc.... Taxes and insurance due and I'll be darned if I'm paying it....(oh and due to the BK we do not qualify for any foreclosure moratorium in California) So WHATS taking them so long ?????? You would think they would want to recover their money, or at least part of it....BofA/Countrywide....where one hand doesn't have a clue what the other hand is doing.....

              No payments since Oct '08. Got Notice of Default (NOD) in Feb '09. Got Notice of Sale (NOS) late July '09. House to be auctioned off next week, Aug '09.

              I hope nobody buys the house. It's the 2nd mortgage owner foreclosing. They also service the 1st mortgage but it's owned by another company out of state.

              If house is sold, I will try and buy more time by saying I have a tenant in the house. May just have friend pretend to be renting place from me. This should give me an additional 60 days in California before eviction. I'd just like another 2 to 3 months to save more money as I didn't save when I was unemployed.

                I live in FL and have a first with Citi and a second with Chase. I stopped paying Nov. 08.
                I stopped paying my $550 association fee in in May.

                Citi filed a lis pendens back in February. I have noticed on the county website that the court is moving to dismiss the foreclosure due to inactivity. They have until Monday to respond.

                Chase still sends me a monthly bill, but I got a letter last week saying they might have to seek other action. Funny I got a letter from TIME magazine saying I owed them for a subscription that was more threatening.

                I haven't filed, but plan to do so next month. I am procrastinating because as soon as I file I have to start paying that damn association fee.
                Once you lose everything you're free to do anything.

                  Same story here, also in Florida.

                  No mortgage payments since January 2009. No lis pendens, not even a peep out of BOA/CW.

                  No payments on any other debt since January 2007.

                  One small judgment that cannot be collected, against my wife for a card that was in her name only.

                  Creditors seem fairly impotent these days, at least in our case.

                    Oh, and beware those collectors for TIME, NEWSWEEK, and especially the Columbia House Record Club. Those are some seriously scary folks.

                    I think they recruit their collectors in tough inner-city neighborhoods and bus them to call centers all over the nation. We had three guys with baseball bats and clipboards show up here last month demanding we turn over all of our old copies of TIME magazine.

                    What in the world?!?

                      In our case, it was nearly 2 years without making payments until we were able to get into a forbearance agreement. We're currently in the HAMP-processing (first trial-payment due 09/01).

                          You know I've heard all the stories about paying or not paying the association fees. I stopped paying mine about 4 months ago just before I filed. Hopefully it complicates the finality of the foreclosure of my house and delays my inevitable exit from my house. Time is all I need. I got some late notices on the HOA but they kind of just stopped sending them. Wish I knew that I could have had the HOA dismissed in bk when I was making payments up until month before I filed.

                          I'll see what happens in the end.

                            Advice on foreclose after ch7

                            Thinking about doing this but wondering what payments you'd need to keep up on. Presumably insurance (for your stuff) but would you need to pay the property taxes? Aren't those attached to the property itself and thus the responsibility of the lienholder?

                              In our case, insurance and taxes werepaid by the lender, but I don't know if that's always the case.
