    Foreclosure timeline after bankruptcy

    We filed in January and discharged in March (chpt 7) and did not re-affirm on either 1st or 2nd mortgage. We stopped making payments in June and are now receiving priority mail listing a notice of default date. We have not received an actual foreclosure or sheriffs sale notice yet. I have read Minnesota redemption period is 6months from this date? How is it the home can be auctined off or sold and I still live there? I've never heard of someone buying a foreclosed home with old owners still living there. I dont want to have the locks changed or have these buyers come to my house expecting me out?

    This is more common than most think.

    Once the auction is done and the deed transferred they will start the eviction process, so you will have notice and some time. Maybe not much, but some.

    This is where some lenders or their agent will approach the previous owners with an offer of Cash For Keys. It could be a few hundred or even a few thousand bucks to make sure you don't fight the process or destroy the home out of spite. You may get an offer for a few thousand to leave sooner and then decreasing amounts for each week or month longer that you need.

    Redemption only comes into play if you have the funds to redeem, and the property can be done with the foreclosure and eviction process before the redemption period expires.

      No one can make you leave without going through a legal eviction process.
      Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

        You are in MN. You WILL have 6 months from the Sheriffs sale date. IF it is bought at auction, the buyer may offer you some incentive to move but you don't have to move until 6 mo after the sale date.
