I don't know if anyone has seen this before but I found a foreclosure timeline for each state.

    Here's the link

Very Cool tool! I wonder if this is running pretty true with all the foreclosures going on now days?

I would guess you could treat these guidelines as a minimum. I would imagine in some places they are grossly under-estimated.

Yes, I have heard in CA they are running much longer.

I am in Florida Middle District and we are currently approaching 9 months, or 270 days, and have not even received the Notice Of Default. No lis pendens has been filed either.

That puts us at more than double the listed amount on that site (135 days).

We live in a fairly expensive neighborhood, and the utilities on this house run about 3k per month. Yes, 3k. The electric alone is 800-900 per month in summer, and I suspect the bank would rather not take over that payment any sooner than they must.

Since it is Florida, leaving a property without some amount of AC in summer would invite mold and all sorts of very rapid deterioration. The home was once worth 700k and is probably now worth 250k, but a little mold could make it uninhabitable and reduce the value to almost zero.

We will see. I hope they move soon now, since we have saved enough money and accessed relatives for money to buy a smaller home outright, free of mortgage. We are staying here for now, though, so we can take care of the place until the deed changes hands. We had originally intended to fight the foreclosure to buy time, but they have given us more than enough time without a fight.

Wisconsin seems to be on time. We stopped paying last December. On June 3rd our foreclosure papers were signed by the judge and our redemption period started. So 1yr from non payment to redemption period over.

So, does this mean you can continue to live in your house after quitting paying the mortgage during the bankruptcy process? At what point do you actually have to move out?

You absolutely can live in your house rent-free, often for months, after filing and surrendering your house as a part of your bankruptcy.

You have to move out of the house when its ownership is officially transferred to someone else after the auction, or when the lender takes official ownership of the home back. Don't wait until the last minute to find another place to live, but depending on the state you live in, you could have quite a while before anything happens that forces you to vacate.

Thank you so much. I am learning so much on this forum. Many of the things I have learned would have never dawned on me. This is one of the best forums I have seen on the internet and I appreciate every single post.

We will most likely walk away from our house at some point after filing. Looks like we won't get as much time to live "rent free" as some other states though...the chart says GA has a 37 day process period.
