We included our home in our ongoing Ch 7 but did not state we wanted to reaff, we do - but for a lower amount than owed since it is upside down. We have been making partial payments, and the lender has motioned for relief of the stay. If they are granted this, and then we attempt to work out a mod and it doesn't work out, and we walk - am I any different than any one else walking away from homes? Meaning, will they come after us for fees associated with the BK motion, etc - or do we just walk and there is no deficiency since they got their house back?
