Could you call the hoa and tell them you have filed BK7 and tell them you are surrendering the house and what they want to do about the hao??? Or is that a waste of time?

My Attorney told me to list HOA as a unsecured creditors (with all the monies owed listed) as of date of filing. This date of filing is strategically scheduled right after condo auction...so any potential debts related to my ownership are included into the filing, and all other subsequent charges/HOA/liabilities get's forwarded to the new owner (Citi)

That is what you owe before filing. It is more like what we will owe after filing and waiting for them to forclose. Right??? If we don't keep paying them.

Right. Anything after the date of your discharge and before the foreclosure's sheriff sale, you will most likely owe. So if your sheriff's sale is a month after your discharge date, you will owe a month. My guess is the bank will pay your past dues after the discharge date, but I have read in some instances they won't.

I just keep paying the darn thing HOA. I only thing I don't like is that it could take a while to forclose.
